Amendment No. 2 - Letter of Conditions


Dear Chairman Brister:


This letter establishes conditions which must be understood and agreed to by the lmmokalee Water and Sewer District and amends the Rural Development Letter of Conditions (LOC) dated March 31, 2016, which was accepted by the District on March 31, 2016 and Amendment No. 1 dated July 18, 2016. All requirements of the previously issued Letter of Conditions (as amended) remain in effect except as modified herein.


This Letter of Conditions - Amendment No. 2 is being issued to revise the project budget in accordance with the revised budget provided with the bid recommendation. Please refer to page 2, SECTION I - PROJECT DETAIL, of the original Letter of Conditions dated March 31, 2016, and replace the Project Budget section with the following:

The budget includes contingency funds equal to 5% of the four bids recommended for award. Additional contingency funds have been allocated specifically for additional asbestos cement (AC) pipe removal and disposal, not currently included in the construction contracts, if later required by Collier County or other permitting agencies. It is understood and agreed by the District that after completion of the approved project, as designed, any unused contingency funds allocated for the additional removal and disposal of AC pipe will be de-obligated by Rural Development without further notification. Any reduction in funding will be applied to grant funds first.
